Guess What?

 

Dr. Kaplan and Dr. Tolley do not want the public to have access to my website that teaches “informed consent prior to dental treatments being performed!” And it shows the public what they did to my teeth.

 

Dr. Kaplan and Dr. Tolley claim that my website is slanderous (not truthful) and is:

  1. in violation of Florida law;
  2. an interference with the Plaintiffs' (dentists') right to privacy;
  3. an assault upon the privacy rights of each of the health care providers whom she harmed professionally;
  4. an assault upon the rights of the public to secure their privacy; and
  5. a public nuisance

 

I received a certified letter on October 8, 2004, from the attorney’s for

Dr. Kaplan and Dr. Tolley -- McIntosh Sawran et al.

They instructed me to “CEASE & DESIST AND

                                        NOT TO BE POSTED ON ANY                                         WEBSITE

 

I will summarize for you the letter.

 

I do not see any reason to not publish this letter, but as an act of good faith, I will show some respect as a layperson to these attorneys.

 

 

My Summary of their Letter

 

I cannot contact these 2 dentists directly.

 

In their opinion, my website was created for the “sole purpose of slander and defamation” against Drs. Kaplan, Tolley, Blake, Mohaupt, Mohaupt and the Florida Board of Dentistry and their staff, and independent expert, Dr. Robert Ferris.

 

They claim I have violated the confidentiality provision outlined in the Florida Statutes as it relates to inquiries to dental licenses - Statute 456 et al.

 

These doctors participated in the process in good faith and the State of Florida determined that they “have done nothing wrong”.

 

My website is a “vengeful and desirous” of destroying the good names of these doctors.   These doctors have unblemished records and are well-respected professionals in their field. 

 

They commented on the fact that I deleted my home address from my correspondence.

 

If I fail to shut down this site, they will be left with no choice but to file an injunction in West Palm Beach to enjoin me to do so (no later than October 15, 2004).  They will seek the recovery of all fees and costs associated with having to file such a motion.

 

These doctors do not give their consent for your website content; they will not consent to any discussion with the media regarding your care or any other patient; they will not waive their confidentiality to the Board of Dentistry proceedings; and they will not accept any further contact from you or any representative on my behalf.

Do not threaten me again or make any attempt to deny my right of “freedom of speech." 

 

My website www.dentalfraudinflorida.com is a teaching website that publishes the dental procedures and treatments fraudulently done to my teeth without my informed consent and inadequate follow up care.  The website stresses to the public the need for informed consent prior to any dental treatment being undertaken.  I have selflessly and courageously set aside my own shame and teach and explain by my own dental tragedy. 

 

The intent and goal of my website are to provide information to the public on dental treatments and support to victims such as myself through a forum and ultimately a support group.  I will always give any dentist involved in any claim made by an individual the opportunity to post a response and open dialogue.

 

I have no intention of trying to portray a “1-sided” story to the public or the Media.  Hence, the publication of my medical records / files and correspondence with all related parties in order to prove that my dental treatments and experiences are truthful.

 

 

 

 

Your claim that I am being “vengeful and desirous” is not correct, in fact, these characteristics are indicative of your clients’ behavior.  I do not instruct anyone to not seek dental treatments from your clients.  Furthermore, I have no financial rewards or incentives related to my teaching website.

 

It is in the public’s best interest to know what was done to myself.  It is my responsibility and duty to do everything I can to publicize the need for informed consent prior to dental treatments.  I do not want anyone suffering the way I am from unnecessary dental treatments and inadequate follow up care. 

 

No one should be looking at the future I am facing to try to keep his or her mouth and jaw restored, functioning properly and pain free.

 

All parties concerned were notified on October 1, 2004, (launch date of site) and given the opportunity to post their responses.  In fact, everyone involved in my dental treatments have been invited and encouraged to participate in my website forum.   To date, these dentists that were “well paid in full” have not answered my specific questions supporting the dental work that they proposed and performed in my mouth. 

 

The Florida Department of Health has not responded or given any explanation for Dr. Ferris’ conduct and actions during my “independent clinical review” on May 14, 2004, (please refer to my letter to the Department of Health detailing what took place during this meeting).  Nor have they given any explanation as to why they revoked my right giving me 60 days to provide additional information for their consideration.

 

I did not agree nor did I sign any agreement with the Florida Department of Health to not discuss or publish the dental work that was done in my mouth, my experience with their department and their “clinical expert," Dr. Ferris.  I would never give up my right to “freedom of speech."

 

Dr. Ferris was paid with taxpayer’s money to provide an “independent clinical review” of the dental treatments done in my mouth, including informed consent.  He was not allowed to speak with any of the dentists involved in my dental care.  His actions besides being reprehensible were unethical and unprofessional.

 

 

 

I suggest that your clients answer my questions and provide the missing information / documentation from my files.  If your clients practiced honest dentistry, obtained my informed consent for their dental treatments, and provided responsible follow up care, then they have nothing to hide and no reason not to participate in discussing the dental work that they performed in my mouth either on my website or with a representative from the Media.

 

If it pleases your clients, I am willing to post a Notice on my website stating:

 

“Dr. Kaplan and Dr. Tolley do not consent to my website content; they will not consent to any discussion with the media regarding my care or any patient’s care; and they do not waive their confidentiality to the Board of Dentistry proceedings.” 

 

Please advise.

 

Once again, I will post all responses / rebuttals in their entirety.  I have no desire or intent to “mislead” the public either in print or publicly speaking concerning the dental procedures performed that destroyed my natural healthy teeth.
